Hardhill Private Hire Ltd (trading as Hardhill Executive Hire)

Private Hire Terms and Conditions.

(Separate Tour Operator” T&C’s are available on request)

The following are the terms and conditions for Hardhill Executive Travel (HET) for Private Hire bookings.

Deposits, Invoicing & Payments

Unless agreed otherwise with the Hirer, the following process will be followed.

  • Hardhill will accept an email or telephone call from clients as a provisional booking.
  • Deposit – The booking remains provisional and is only confirmed when a 25% non-refundable deposit is received.
  • Deposit – Any booking where the deposit has not been received within 14 days of the booking being made, HET reserve the right to cancel the booking without notice.
  • Invoice – Hirer’s will be invoiced by HET as per the agreed quote (less the deposit), 14 day prior to travel date.
  • Invoice – Full payment is expected no later than 7 days before travel.
  • If full payment is not received the hire will NOT go ahead and the non-refundable deposit will be retained. (see cancellation fees below).

Cancellation & Administration Fees

If in the event that a client has to cancel a booking the following terms and conditions apply:

Cancellation by HET

In the event that HET has to cancel the booking a full refund of all monies paid will be provided. Refunding the sums paid to the Hirer shall be the full extent of HET’s obligations and such repayment shall constitute a full discharge of any claim.

Insurance

Whilst HET holds insurance that more than meets all statutory requirements, we strongly recommend that passengers hold suitable comprehensive medical, travel and cancellation insurance.  HET cannot be held responsible for any delays in travel that affect onward travel.  Passengers own travel insurance should cover passengers for all eventualities in travel.

Vehicle Damage or Soiling

The Hirer shall indemnify HET in respect of any damage and associate costs or losses.  This includes any vehicle damage or internal soiling caused by any passenger during the period of the hire. 

Vehicle Size

EHT reserve the right to provide, without notice to the Hirer, a larger vehicle than specified.  No additional charge will be made, assuming the Hirer does not then increase the number of passengers beyond the seating capacity originally requested.

Subcontracting

In the event a vehicle is not available within the EHT fleet, EHT reserve the right to, for any reason, to hire in a vehicle from other contractors to satisfy the Hirer’s requirements (unless specifically instructed to the contrary).  In this event, EHT would be acting as an agent for the Hirer.  Any terms and conditions imposed by such subcontractors shall be binding on the Hirer, as if they had directly contracted such services.

Complaints

We pride ourselves on providing an excellent service, and we hope  you have no cause to complain, but in the event of this being necessary, any complaint should be done in writing as soon as possible and, in all events, within 14 days of the end of the hire.  This will allow us to review what happened while memories are fresh of the incident.

Applicable Law

These conditions and also any contract with EHT and the Hirer will be governed by Scottish Law.  In the event of any dispute, both parties agree to submit to the exclusive jurisdiction of the Scottish courts.

Personal Information

Your personal information will only be held  and used by EHT for the purposes of the Hire of our services.  No personal information will be passed or sold to 3rd parties.  Any information we collect will only be used in accordance with the Data Protection Act 1998 and general Data Protection Regulations 2018.

Force Majeure

EHT does not accept any liability for any loss, inconvenience or damage caused by war, threat of war, riot or civil commotion, terrorist or criminal activity, industrial disputes, natural disasters, fires, illness weather conditions, road traffic conditions, temporary technical, electrical or mechanical breakdown.
